LIMA — A Lima man who police say shot another man in the leg during an incident earlier this year at Harry’s Hideaway bar in Lima has been given two weeks to accept or reject a plea deal offered Wednesday by prosecutors.
If Oliver Jackson Jr. elects not to accept the offer, his case will proceed toward a scheduled Sept. 14 jury trial.
Jackson, 49, appeared in Allen County Common Pleas Court on Wednesday to waive his constitutional right to a speedy trial. He was indicted by a grand jury in May on three counts of felonious assault, second-degree felonies that each include specifications for the use of a firearm during the commission of a crime. Jackson was also charged with a third-degree felony count of having weapons under disability.
Under the proposal crafted by prosecutors, if Jackson pleads guilty to one of the felonious assault charges, including the gun spec, the remaining charges will be dismissed. Jackson has until the conclusion of a scheduled July 16 pre-trial hearing to accept the deal.
The charges against Jackson stem from a shooting Feb. 29 Saturday at Harry’s Hideaway, located at 1452 N. Cable Road. Stephen Snyder, 39, of Lima, was shot in the leg and was taken to a local hospital for treatment of non-life threatening injuries in the incident.
Assistant Allen County Prosecuting Attorney Kyle Thines said Wednesday that two eye witnesses have identified Jackson as the man who shot Snyder. Police said the business and two cars were also struck by gunfire.
Defense attorney Zach Maisch also argued successfully on Wednesday that Jackson’s bond should be reduced and judge Terri Kohlrieser agreed, cutting the bail amount in half and setting the new bond at $100,000. If Jackson manages to post bail he will be placed on house arrest, Kohlrieser said.
