Lima man pleads guilty to rape

LIMA — A jury trial in the Allen County Common Pleas Court was canceled Monday after a Lima man pleaded guilty to rape.

Judge Terri Kohlrieser will sentence Joshua Vititoe, 39, on June 27.

Also included in this case was a suppression hearing at the end of March, when Steve Chamberlain of the Allen County Public Defenders Office argued that all statements Vititoe made to police should be suppressed because police didn’t tell him about his right to remain silent or to have an attorney present during questioning. Kohlrieser overruled the request because she found the police properly advised Vititoe of his rights.

This case deals with an incident that occurred on Dec. 8, 2023, at the Country Inn on Elida Road, when a female reported to the sheriff’s office that Vititoe sexually assaulted her by digital penetration when she allowed him to spend the night with her.
