Lima man pleads guilty to burglary, weapons charges

LIMA — A Lima man accepted a deal from prosecutors on Tuesday, one week before a his jury trial was slated to begin in Allen County Common Pleas Court.

Derrick Irons, 23, was indicted by an Allen County grand jury in February 2019 on charges of aggravated burglary and felonious assault, each first-degree felonies and each carrying a three-year specification for the use of a firearm during the commission of a crime. Irons was also charged with improperly discharging a firearm at or into a habitation, a felony of the second degree, also with a three-year firearm specification, in addition to misdemeanor counts of domestic violence and violating a protection order.

During his appearance Tuesday before Judge Jeffrey Reed, Irons accepted a deal from prosecutors that called for him to plead guilty to an amended count of burglary, a second-degree felony with a reduced one-year gun specification; and the improper discharge of a weapon into a habitation. The firearm spec on that count was also reduced to a one-year charge.

With his plea of guilty to the amended counts, prosecutors dismissed the remaining counts. Irons will be sentenced April 20. Each of the second-degree felony counts carry maximum prison sentences of eight years each. Irons will serve the sentences for the firearm specs, which would be served consecutively or concurrently, before any prison term on the felony charges would commence.

The charges allege that Irons did on or about Nov. 8, 2018, trespass in an occupied structure at 1663 Rebecca Place, Lima, “with the purpose to committee a criminal offense” while in the possession of a pistol.
