LIMA — A man who court documents said is homeless was indicted this month by an Allen County grand jury on charges of felonious assault for choking his girlfriend to the point of unconsciousness.
Rubiero Litmon, 23, was indicted on a second-degree felony charge of felonious assault.
The incident occurred shortly before midnight Oct. 16, police officials said. On that night, police officers were called to 907 Richie Ave. on the report of a domestic disturbance. According to a report filed by Lima Police Detective Steve Stechschulte, officers upon their arrival found Michelle Tate on the porch of the residence with “obvious signs of being assaulted.”
Tate was bleeding from wounds to her face and had ligature marks on her neck, indicating strangulation, the detective wrote.
She told police officers her boyfriend, Litmon, had caused the injuries. Tate said Litmon strangled her and caused her to lose consciousness. When she regained consciousness, the physical confrontation continued, Tate told police officers.
As Litmon reportedly continued his attack, the Tate’s 10-year-old child called police. Litmon then fled the residence but was shortly apprehended a few doors away, court documents show.
Litmon is scheduled to appear in court Tuesday for a pretrial hearing.
