LIMA — An Indianapolis teenager in court for sentencing Wednesday in the armed robbery earlier this year of a Lima Walgreens pharmacy instead asked for permission to withdraw his earlier plea of guilty.
Treyvon Manning, 19, is one of four young Indianapolis residents charged with the April 26 early-morning robbery of the Walgreens store at the intersection of Allentown and Cable roads. All four have been charged with aggravated robbery with firearm specifications, felonies of the first degree. One of the teens has already been sentenced for his role in the robbery.
Judge David Cheney of Allen County Common Pleas Court opened Wednesday’s hearing with the announcement that he had received a letter from Manning earlier in the day in which the defendant asked to withdraw his previously entered guilty plea. Upon questioning by the judge, Manning said his request was based on new evidence that has been discovered in a case against him in Shelby County.
Manning and his co-defendants were arrested in Shelby County on the morning after the Walgreens robbery.
Cheney agreed to allow Manning’s court-appointed attorney, Joseph Benavidez, to file a motion with the court to withdraw the guilty plea. A hearing on the matter was scheduled for 3 p.m. Nov. 17.
Seneca Rivers, 18, of Indianapolis, pleaded guilty earlier this month to a reduced charge of aggravated burglary in connection with the armed robbery and was sentenced to five years in prison, with a mandatory additional three-year sentence for carrying a gun during the execution of the crime.
Prosecutors said Rivers jumped over a counter in the pharmacy area of the store, pointed a gun at the pharmacist on duty and demanded he remove oxycodone from the safe.
Prosecutor Jana Emerick said oxycodone pills with a street value of $18,000 were given to the defendant before all four assailants fled from the store.
Quintez Hawkins, 19, is scheduled to stand trial beginning Dec. 18 for his role in the robbery. Abigail Lee, 26, who investigators said was the driver of the getaway vehicle, will appear at a change-of-plea hearing that has been scheduled for Nov. 30.
