Attorney wants evidence tossed in child sex case

LIMA — The defense attorney representing a man accused of sex crimes against children tried Monday to question an officer’s computer skills and training.

Ronald Payne’s attorney, Greg Donohue, asked Lima Police Department Investigator Tim Goedde about his training, including whether it included any formal schools he attended.

Goedde said he received training on the job, did go to school to learn police interview techniques and has handled more than 300 cases as an investigator.

Judge Jeffrey Reed asked Donohue and the prosecution to file written arguments on Donohue’s motion to suppress computer records and evidence seized from Payne’s home.

Payne is scheduled to stand trial Aug. 22. He is charged with rape, three counts of attempted rape, 12 counts of gross sexual imposition, two counts of trafficking in persons, 17 counts of illegal use of a minor in nudity-oriented material or performance, and 17 other counts of illegal use of a minor in nudity-oriented material or performance.

Officials said the crimes occurred between Jan. 1, 2014, and Jan. 27, 2015. One of the victims was a 12-year-old girl and the other was a 15-year-old girl, Assistant Allen County Prosecutor Terri Kohlrieser said.

Some of the charges carry up to life in prison as the maximum sentence.

The illegal use of a minor charges accuse Payne of obtaining child pornography on his phone, transferring it to his computer and saving the files, Kohlrieser said.

The children were not related to Payne. They were acquaintances, Kohlrieser said.

The trafficking charges accuse Payne of transporting the children somewhere else to engage in sexual activity and giving them some type of payment, Kohlrieser said.
