Grand jury: Cop justified in Celina fatal shooting

CELINA — An Ohio State Highway Patrol officer will not be charged after a November fatal shooting incident after a grand jury declined to indict him.

At 1:30 a.m. Nov. 29, Trooper Brandon Chaney was in his patrol car on Main Street in Celina, working on paperwork from a previous incident. Justin McHenry, 22, parked his vehicle across the street and approached Chaney’s car, becoming confrontational and ordering him out of the vehicle.

According to a report filed the day of the shooting by the Wapakoneta post of the Ohio State Highway Patrol, after Chaney exited his vehicle, McHenry pulled out a 9 mm handgun and pointed it at him. After unsuccessfully attempting to disarm him, Chaney shot McHenry, who later was pronounced dead after being taken to St. Rita’s Medical Center.

On Thursday, a Mercer County grand jury reviewed the incident and concluded, after considering eyewitness testimony as well as other evidence, that McHenry’s actions presented an imminent threat of serious physical harm to Chaney, making his use of deadly force reasonable and justified.

No other information was available from the Mercer County Prosecutor’s Office on Monday.
