LIMA — A suppression hearing was held Thursday for a Lima man charged with 12 counts related to sexual conduct with a minor.
Brevin Luna, 20, was indicted on two counts of unlawful sexual conduct with a minor, fourth-degree felonies; four counts of pandering sexually-oriented matter involving a minor or impaired person, second-degree felonies; illegal use of a minor or impaired person in nudity-oriented material or performance, a second-degree felony; and five counts of pandering sexually-oriented matter involving a minor or impaired person, second-degree felonies. Court documents stated the girl involved is 15 years old.
Luna’s attorney — Stephen Chamberlain of the Allen County Public Defenders Office — filed a motion to suppress the interview Luna had with a detective at the Shawnee Township Police Department because he said Luna’s rights were never explained to him. Allen County Common Pleas Judge Jeffrey Reed received a copy of the interview and will review it before making a decision on whether the interview could be used as evidence by the prosecution if the case goes to trial.
A speedy trial waiver was also offered to Luna so Chamberlain would have more time to prepare his case. Luna didn’t sign it because he wanted the case to be done quicker. Luna seemed confused about how his case would proceed, and Chamberlain said he would explain it to him in more detail and what it means to waive his rights.
