LIMA — A Lima man faces up to five years behind bars when he is sentenced March 26 on a charge of gross sexual imposition.
Dustin Herron, 35, pleaded guilty on Friday to the third-degree felony that alleged he inappropriately touched a 12-year-old girl last summer.
According to court records, Lima police were called on July 25 of last year to a home in the 1100 block of North Baxter Street in reference to a 12-year-old female who had been “held down” by an adult male. The juvenile told police Herron had pulled her onto his lap and touched her buttocks and breast outside her clothing. She was able to escape his grasp and go outside, records show.
The young girl later came back inside the residence and Herron is alleged to have grabbed her again and placed her on his lap, she told police. He once again grabbed her buttocks and breast, she alleged. The young girl then fled across the street and called her grandmother for help. Police arrived shortly thereafter.
Court documents state that Herron admitted to police that he had grabbed the juvenile in an inappropriate fashion.
The Lima man was sullen in court on Friday and answered Judge Terri Kohlrieser’s questions is a barely audible voice. His attorney, Athena Nyers, attempted to get Herron’s $100,000 bond lowered, but prosecutors objected.
Assistant Prosecuting Attorney Mariah Cunningham said Herron has “a history of felony convictions” and is a “danger to the community.”
Kohlrieser ordered a pre-sentence investigation be completed prior to sentencing.
Herron will be labeled a Tier II sex offender. As such he will be required to register with the authorities every six months for the next 25 years, the judge said.
