LIMA — A Lima man faces the possibility of life in prison after pleading guilty to two counts of rape involving an 11-year-old female.
Terry Jackson, 35, appeared in Allen County Common Pleas Court for a change of plea hearing Thursday morning. Under the terms of a negotiated agreement with prosecutors, the Lima man entered guilty pleas to the two amended counts of rape, both first-degree felonies, in exchange for the state’s dismissal of specifications that classified him as a sexually violent predator and also removed language alleging the use of force from the indictment.
Also dismissed were counts of kidnapping, a first-degree felony, and pandering sexually-oriented material involving a minor or impaired person, a second-degree felony.
Assistant Allen County Prosecuting Attorney Kenneth Sturgill said the deal was reached “with help from the victims” in the case.
Jackson was indicted by a grand jury in July on the original four counts. The charges alleged that he engaged in sexual conduct with a person less than 13 years of age at a Lima residence on or about May 27 of this year.
According to court documents, Jackson took four juveniles, ranging in age from 7 to 12, to his residence for a sleep-over. At approximately 4:30 a.m. that morning, one of the girls contacted her mother to come and get her, alleging that Jackson had tried to touch her inappropriately and had used a knife to threaten her.
The 11-year-old girl told investigators that Jackson forced her to perform oral sex on him and took a video of the act as it occurred. Jackson initially denied the allegation, according to court documents, but admitted to police after evidence was found on his cellular phone substantiating the allegations that he had indeed forced the young girl to perform a sex act on him.
Jackson will be sentenced Dec. 2. Judge Jeffrey Reed said the sentence for each rape count is 10 years to life. It will be up to the judge to decide if the sentences will be served concurrently or consecutively. A pre-sentence investigation was ordered.
As a Tier 3 sex offender, Jackson will be required to register with the authorities every 90 days for life.
