Trio of Road 5 residents head to trial, rest settle with county

OTTAWA — Frank Reed, the Columbus based attorney representing the Putnam County Commissioners in the Road 5 litigation, said all but three Road 5 residents have accepted settlements offered by the commissioners during last Thursday’s pre-trial hearing.

Mark Maag, Bill and Mary Kay Weis and Anne Nienberg decided not to settle but to continue to trial, Reed said.

“It was Putnam County’s hope that all the land owners would settle,” Reed said. “We believe the offers we made were very fair and we were hopeful it would completely resolve the case.”

A jury will decide the value of the property confiscated by the Putnam County Commissioners from the remaining Road 5 residents at 9 a.m. Oct. 9 in Putnam County Common Pleas Court.
