LIMA ó A couple are suing a local tax company, one of its drivers and its insurance company over an accident.

DeWayne Carter Sr. and Jeannetta Carter filed the lawsuit in March in Allen County Common Pleas Court against Black & White Cab Co., taxi driver Sheila Perkins and Progressive Preferred Insurance Co.

The Carters are seeking more than $25,000 in damages. Health insurance company AETNA also is named as a defendant in the lawsuit in case it has any claims that could affect the action, according to the lawsuit.

Black & White owner Tim Hogan said itís not uncommon for his company to be sued if its driver is involved in an accident. He said he could not recall the accident.

The accident happened July 17 when DeWayne Carter was driving east on East Vine Street. Jeannetta Carter was a passenger in the vehicle. Perkins also was driving east and struck the Cartersí vehicle, according to the lawsuit.

The Carters suffered severe and permanent injuries along with pain and suffering. DeWayne had $9,359 in medical bills, the lawsuit said; Jeannetta had $1,414 in medical bills.

Progressive has refused to pay the Carters for the accident, according to the lawsuit, and no settlement has been reached.

Perkins was issued a traffic ticket for assured clear distance and paid a $25 fine for an incident on the same date, according to Lima Municipal Court records.
