Shurelds sent to prison on probation violation

LIMA — Marquavius Shurelds’ attorney told a judge Wednesday the real reason authorities sought to send his client to prison was a belief he is connected to the slaying of his girlfriend.



“Let’s just lay the cards on the table. They don’t have enough evidence to charge him with the murder they are investigating. They want to charge him with this and lock him up,” Shurelds’ attorney, Mike Dugan said. “This is being used as a tool to lock him up.”



But Judge Jeffrey Reed said Shurelds' alleged involvement in another case has nothing to do with the hearing on whether he violated his probation and whether he should go to prison for it.



“I’m not considering whether he is a suspect in another crime,” Reed said.



Police called Shurelds a “person of interest” in the April 6 shooting death of Tara Cutlip at her home at 1157 Bahama Drive. She was pregnant when she was slain. Her unborn baby also died.



Shurelds has not been charged in Cutlip’s death.



Assistant Allen County Prosecutor Jana Emerick called Shurelds’ probation officer, Gwen Scott-Thompson, to testify. Scott-Thompson said Shurelds failed to report for five months despite having requirements to report three times a week.



Shurelds has a history of crime dating back to his childhood. He also has a history of probation violations, according to testimony.



Reed ruled Shurelds violated his probation and ordered he serve three years in prison after Shurelds asked him for one more chance.



The probation violation is for a conviction of having a weapon under a court sanction from 2010. Shurelds was placed on probation for having a gun and shooting it Jan. 1, 2009, in the 600 block of Faurot Avenue. Police chased him down and found the gun he tossed during the chase. His DNA was found on the gun handle and trigger, Emerick said.
