LIMA ‚?? The case against a former county employee accused of keeping her ex-husband on her health insurance policy after their divorce will proceed to trial, a judge ruled.
Crystal Balo‚??s criminal case will go to trial May 11. Common Pleas Judge Richard Warren refused to dismiss the case as requested by her attorneys.
Balo, 31, is charged with grand theft by deception, a fourth-degree felony that carries up to 18 months in prison. Balo‚??s attorneys tried to argue she was not properly notified of the charge against her, which violated her Sixth Amendment Constitutional right to be fully notified of the accusations against her.
Balo no longer works for the county. She was fired following an audit of the county‚??s insurance program that discovered the issue. The county is continuing the audit looking for anyone else who may have committed the same crime.
Balo‚??s ex-husband, Steven Balo, 39, was convicted of misdemeanor insurance fraud. He was given a 60-day suspended jail sentence and ordered to pay $5,634 restitution, which he did.
