Accused dog killer asks for trial date

LIMA  - A man accused of beating a dog to death waived his right to a speedy trial Tuesday and asked for his case to be assigned a trial date.


The requests were made through an attorney representing Dennis L. Phalen, 68. He did not appear in court. No dates were set late Tuesday but will be in the near future.


Phalen is charged with cruelty against a companion animal, a first-degree misdemeanor. The charge carries a maximum penalty of six months in jail and a $1,000 fine.


Phalen is accused of beating a Schnauzer-type dog to death with his hands and fist until the dog’s head caved in. The incident stemmed from a fight he had with is wife, officials said.
