AKRON — A Lima woman who is HIV positive and had sex with two men without telling them her health status was sentenced to eight years in prison Monday.
Kelley Bean, 48, was sentenced on two counts of felonious assault, both second-degree felonies. A Summit County jury convicted her a month ago during a trial.
Bean failed to inform the men of her HIV status prior to having sex with them. The charge is a felony if the person with the illness fails to disclose it before having sex.
The first crime happened with a man in 2009 and 2010. The second crime happened with a second man in 2012. Bean had sexual relationships with both men, said April Wiesner, a spokeswoman for the Summit County Prosecutor’s Office said.
“We do not know whether she intentionally attempted to infect these men with HIV,” Wiesner said.
Bean was convicted of soliciting in 2007 in Lima. She was sentenced to 30 days in jail and fined $150, according to Lima Municipal Court records.
